3. Definitions
In these Terms & Conditions, “LuxaYacht”, “we”, “us”, or “our” means GOLDEN COAST TRAVEL LTD operating through the LuxaYacht brand. “Customer”, “you”, or “your” means the person making a booking, enquiry, or payment, and any participant included in that booking.
“Service” means any yacht rental, private boat tour, harbor experience, transfer, travel-related activity, concierge arrangement, or related service offered, marketed, coordinated, or arranged through LuxaYacht. “Supplier” means an independent yacht owner, captain, boat operator, tour operator, transfer provider, local agency, guide, crew member, or other third-party provider involved in delivering the Service.
4. Our Role
LuxaYacht operates as a booking platform, marketing agent, service coordinator, and/or intermediary between customers and independent Suppliers. In some cases, LuxaYacht may act as the direct service provider. In other cases, the actual Service may be delivered by independent yacht owners, captains, boat operators, tour providers, transfer providers, or local partners.
We aim to work with reliable Suppliers and to present services clearly and professionally. However, the operation of yachts, boats, transfers, and local activities may remain under the responsibility and control of the relevant Supplier, captain, operator, guide, crew, harbor authority, or local authority.
5. Scope of Services
LuxaYacht provides access to yacht rentals, private boat tours, daily cruises, harbor experiences, transfers, tourism services, and related travel arrangements. Our services may be available in different countries and destinations. At the current stage, our main operational focus is yacht and boat experiences in Turkey, while the platform may serve international customers and future destinations worldwide.
The exact inclusions, exclusions, duration, route, meeting point, pickup details, food and drinks, capacity, price, deposit amount, remaining balance, and payment terms are shown on the relevant tour page, offer, quotation, invoice, payment link, WhatsApp message, email, or booking confirmation.
6. Service Descriptions, Photos & Availability
We try to keep all website information accurate and up to date. However, yacht availability, supplier availability, routes, schedules, prices, included services, and operational details may change due to weather, sea conditions, maintenance, safety decisions, harbor rules, seasonal changes, demand, or supplier circumstances.
Photos, videos, route descriptions, and sample itineraries are provided to help customers understand the experience. Unless explicitly confirmed in writing, images may be representative and the exact yacht, boat layout, decoration, route, crew, stop sequence, or equipment may vary.
A booking is not confirmed only by submitting a form, sending an enquiry, or receiving an automated website response. A booking becomes confirmed only after LuxaYacht sends written confirmation by email, WhatsApp, or another official communication channel.
7. Booking Process
7.1 Reservation Request
You may request a booking through our website, WhatsApp, email, phone, social media, or another approved communication channel. You must provide accurate personal information, contact details, destination, preferred date, number of participants, pickup location if applicable, and any special requirements.
7.2 Confirmation
Your booking is confirmed only after we provide written confirmation. Confirmation may include the tour date, time, yacht or service type, pickup or meeting point, deposit amount, remaining balance, cancellation rules, supplier information where relevant, and any special instructions.
7.3 Age Requirement
You must be at least 18 years old to make a reservation. If you book on behalf of other participants, you confirm that you are authorized to do so and that all participants agree to these Terms & Conditions.
7.4 Special Requests
Special requests such as birthday decoration, marriage proposal arrangements, food preferences, hotel pickup, accessibility needs, baby seats, route preferences, or private timing preferences are subject to availability and must be confirmed in writing.
8. Pricing & Payment
8.1 Prices
Prices are shown in the currency indicated on the website, quotation, payment link, or booking confirmation. Some prices may be converted based on your selected currency, payment method, destination, exchange rate, supplier requirements, or payment provider rules.
Unless clearly stated otherwise, prices may not include optional extras, private transfers, premium food and drinks, special decorations, additional hours, harbor fees, entrance fees, personal expenses, or services not listed as included.
8.2 Deposit / Prepayment
Many services require an online deposit or prepayment to secure the reservation. The deposit amount or percentage is shown on the relevant tour page, offer, payment link, invoice, WhatsApp message, email, or booking confirmation.
Paying a deposit does not automatically change the service details unless those details are confirmed in writing by LuxaYacht.
8.3 Remaining Balance
Unless otherwise stated in your booking confirmation, the remaining balance is payable in cash on the tour day. The remaining balance, accepted currency, and payment timing will be explained before or at the time of confirmation.
8.4 Payment Providers
Online deposit payments may be processed securely by third-party payment providers, including Stripe and PayPal. We do not store your full card details on our website. Your payment may also be subject to the terms, security checks, currency conversion rules, fraud checks, or fees of the relevant payment provider, bank, or card issuer.
8.5 Failed, Reversed, or Disputed Payments
If a payment fails, is reversed, disputed, charged back, or flagged as suspicious, we may suspend or cancel the booking until the payment issue is resolved. You are responsible for ensuring that your payment details are accurate and that the payment method is authorized.
9. Customer Responsibilities
You agree to:
- Provide accurate contact, hotel, pickup, participant, and payment information.
- Arrive on time at the confirmed pickup point, harbor, marina, yacht, boat, or meeting location.
- Follow all safety instructions given by LuxaYacht, the Supplier, captain, crew, guide, or transfer provider.
- Ensure all participants meet any age, health, mobility, swimming, or physical requirements.
- Inform us in advance about pregnancy, serious medical conditions, mobility limitations, allergies, dietary restrictions, or other relevant needs.
- Respect the yacht, crew, equipment, other guests, local laws, harbor rules, and safety instructions.
- Supervise children and vulnerable participants at all times.
- Avoid dangerous, abusive, illegal, offensive, or irresponsible behavior.
You may be responsible for costs, losses, delays, or missed services caused by incorrect information, late arrival, unsafe behavior, failure to follow instructions, or damage caused by you or your group.
10. Weather, Sea Conditions & Safety
Yacht and boat services depend on weather, sea conditions, harbor rules, maritime safety requirements, supplier readiness, and the judgment of the captain or operator. The captain, Supplier, LuxaYacht, harbor authority, or local authority may change, delay, shorten, reschedule, or cancel a service for safety or operational reasons.
Routes, swimming stops, cave visits, fishing areas, sunset points, anchor locations, and return times may change due to wind, waves, storms, visibility, harbor restrictions, technical issues, or safety decisions.
The captain’s safety decision is final during the service. No customer may require the captain or crew to operate against safety rules, local regulations, harbor rules, or professional judgment.
11. Pickup, Transfers & Meeting Points
If hotel pickup, private transfer, or meeting point assistance is included or arranged, the pickup time and location will be communicated before the service. Pickup times may vary due to traffic, hotel access, road conditions, other pickups, local restrictions, route changes, or operational reasons.
You are responsible for being ready at the confirmed pickup point on time. If you provide an incorrect hotel name, address, phone number, room information, location pin, or meeting point details, LuxaYacht and the Supplier may not be responsible for delays, missed pickups, missed departures, or missed services.
12. Children, Health, Alcohol & Behavior
Children must be supervised by a parent, guardian, or responsible adult at all times. Some services may not be suitable for infants, pregnant guests, guests with mobility limitations, or guests with certain medical conditions.
Alcohol consumption, if allowed, must be responsible and must not endanger the customer, crew, yacht, other guests, or the operation of the service. The captain, crew, Supplier, or LuxaYacht may refuse service, remove a participant, or end participation if a customer behaves dangerously, abusively, illegally, offensively, or in a way that risks safety.
13. Changes by You
If you want to change the date, time, number of participants, yacht, route, pickup point, or service details, you must contact us as early as possible. Changes are subject to availability, supplier approval, weather, operational limits, and possible price differences.
We cannot guarantee that requested changes will be possible after confirmation, especially close to the service date.
14. Cancellations by You
Your cancellation rights and possible refund options are explained in our Cancellation & Refund Policy, your tour page, quotation, payment link, email, WhatsApp message, or booking confirmation.
Depending on the service type, supplier rules, timing of cancellation, and operational costs already incurred, deposits may be fully refundable, partially refundable, non-refundable, or transferable to another date.
If you do not arrive at the confirmed pickup point, harbor, marina, yacht, boat, or meeting location on time, this may be treated as a no-show. No-shows may result in loss of the deposit or the full amount paid, depending on the confirmed booking conditions.
15. Cancellations or Changes by LuxaYacht or Suppliers
We may need to modify, reschedule, replace, or cancel a Service due to weather, sea conditions, safety concerns, yacht availability, supplier availability, technical issues, maintenance, harbor restrictions, force majeure, or other circumstances beyond our reasonable control.
If a confirmed Service cannot be provided as agreed, we may offer one or more of the following options depending on the circumstances:
- A new date or time.
- A similar or upgraded yacht or service where available.
- An alternative route or adjusted program.
- A partial refund where only part of the service is affected.
- A refund according to the applicable cancellation and refund rules.
16. Supplier Responsibility
Some services are delivered by independent Suppliers. These Suppliers may operate under their own licenses, insurance, rules, safety procedures, and local legal obligations. LuxaYacht is not responsible for Supplier actions or omissions that are outside our reasonable control, except where required by applicable law.
We will make reasonable efforts to assist customers with communication, coordination, and issue resolution when a service involves an independent Supplier.
17. Documents, Local Laws & Regulations
You are responsible for complying with local laws, harbor rules, immigration requirements, identification requirements, customs rules, and any other regulations that apply to your destination or service.
If a service requires identity documents, passenger details, passport information, hotel information, or local registration details, you must provide accurate information within the requested time.
18. Damage, Personal Belongings & Lost Property
You are responsible for any damage caused by you or your group to yachts, boats, vehicles, equipment, property, crew belongings, or third-party property. Repair, replacement, cleaning, or loss costs may be charged to you where appropriate.
You are responsible for your personal belongings. LuxaYacht and Suppliers are not responsible for lost, stolen, damaged, or forgotten items unless required by applicable law. We will make reasonable efforts to help recover lost property if possible.
19. Photos, Videos & Marketing Content
During some tours, photos or videos may be taken by customers, crew, Suppliers, or LuxaYacht. We will not intentionally use close-up images of you for marketing without permission where consent is legally required.
If you send us photos, videos, reviews, testimonials, or social media content, you grant LuxaYacht permission to use that content for customer support, service verification, marketing, website content, and social media, unless you clearly tell us otherwise in writing.
20. Website Use
You agree not to misuse the website, attempt unauthorized access, copy content without permission, interfere with website security, submit false information, or use the website for unlawful purposes.
Website content, including text, images, graphics, layout, branding, logos, service descriptions, and page structure, belongs to LuxaYacht or its licensors unless otherwise stated. You may not reproduce, copy, resell, scrape, or exploit our content for commercial purposes without written permission.
21. Privacy & Personal Data
We process personal data to handle enquiries, bookings, payments, customer support, supplier coordination, legal compliance, analytics, fraud prevention, and service improvement. More information is available in our Privacy Policy and Cookie Policy.
When payment is processed through Stripe, PayPal, or another third-party provider, your payment information may also be processed according to that provider’s own privacy, security, and payment terms.
22. Liability Limitation
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, or any liability that cannot be excluded under applicable law.
To the maximum extent permitted by law, LuxaYacht is not liable for indirect, incidental, special, consequential, or economic losses, including loss of enjoyment, loss of opportunity, travel disruption, missed flights, missed connections, accommodation costs, or additional expenses caused by circumstances outside our reasonable control.
Where LuxaYacht is legally responsible for a claim, our total liability is limited to the amount you paid to LuxaYacht for the affected Service, unless applicable law requires otherwise.
23. Force Majeure
LuxaYacht and Suppliers are not responsible for failure or delay caused by events beyond reasonable control, including severe weather, storms, unsafe sea conditions, natural disasters, fire, pandemic, epidemic, government restrictions, war, terrorism, strikes, harbor closure, technical failures, road closures, supplier emergencies, transport disruption, or other force majeure events.
24. Complaints
If you experience a problem during a Service, you should inform the captain, crew, guide, Supplier, or LuxaYacht as soon as possible so that we have an opportunity to help resolve the issue during the service.
Complaints after the service should be sent to info@luxayacht.com with your booking details, service date, description of the issue, and any supporting photos, videos, payment records, or documents.
We aim to review complaints fairly and respond within a reasonable time, depending on the complexity of the issue and the need to contact Suppliers or local partners.
